Texas is the third-leading state in the rate of bicycle-automobile accidents. Currently, Dallas County is facing an increase in bicycle-automobile accidents, with 1,439 accidents occurring between 2010 and 2016. 21 of which led to fatalities.

  • 345 (24%) of the cyclists involved in these accidents were younger than 26

In Dallas, bicycle-automobile accidents are commonly caused by:

  • Operators turning in front of a cyclist.
  • Operators entering traffic in front of a cyclist.
  • Operators not yielding at an intersection
  • Operators not stopping at a stop sign or a red light.
  • Distracted Operators
  • Operator’s/cyclist’s failure to look both ways after stopping.
  • Cyclists entering the road from the pavement
  • Alcohol consumption.

Texas uses a modified comparative negligence standard, which means that in order for a victim to receive any compensation from a bicycle-automobile accident, the victim must show that the operator was more responsible for the accident than the claimant. Once a jury determines the allocation of fault, then the total amount of damages are subtracted by the percentage of the victim’s responsibility. A cyclist may show that they were less responsible, or not responsible at all, for the accident by following safety precautions while on the road. Some of these include:

  • Obeying traffic laws
  • Using hand signs before turning
  • Wearing bright color clothing
  • Placing a light in front and behind the bicycle
  • Wearing protective gear
  • Keeping a safe distance between cars.
